2. The Service

The Site provides free-to-play browser-based memory and brain-training mini-games. Access is provided "as is" and is supported by advertising.

We reserve the right to modify, suspend, or discontinue any part of the Site at any time without notice.

3. User Conduct

When using the Site, you agree not to:

• Submit nicknames or content that is offensive, defamatory, harassing, hateful, sexually explicit, or unlawful
• Use bots, automation tools, or exploits to manipulate scores or leaderboards
• Attempt to reverse engineer, scrape, or interfere with the Site's operation
• Use the Site to violate any applicable law or regulation
• Impersonate others or misrepresent your affiliation

We may remove user-submitted content (including nicknames and scores) at our sole discretion.

4. Leaderboards

When you submit a score, you grant us a non-exclusive, royalty-free, worldwide license to display your nickname and score on the Site.

Weekly leaderboards reset every Monday 00:00 UTC. Top entries may be preserved indefinitely in a "Hall of Fame".

We reserve the right to remove any score we believe was obtained through cheating, exploits, or any violation of these Terms.

5. Intellectual Property

All content on the Site, including game code, designs, text, graphics, and the "Kioku Games" name and logo, is owned by the Operator or its licensors and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and play the games for personal, non-commercial use.

Third-party assets (e.g., open-source icons, AI-generated images, public-domain sound effects) retain their original licenses, which are documented at https://games.kio-ku.com/credits.

6. Streaming and Video Content

You are welcome to play, record, and broadcast our games on streaming and video platforms (such as Twitch, YouTube, TikTok, Kick, X/Twitter, Bilibili, and others) for any purpose, including monetized content. No licensing fee is required, ever, and we do not claim any portion of your revenue.

We would appreciate — but do not require — that you include a link to https://games.kio-ku.com in your video description, on-screen overlay, or stream panels. This helps other players discover the games.

You retain full ownership of your video, commentary, and recordings.

You agree not to:

• Re-host the game files on your own server, app, or distribution channel
• Imply any endorsement or partnership with Kioku Games without our written consent
• Use the games in content that violates Section 3 (User Conduct)

7. Advertising

The Site is supported by advertising. Some games may offer optional rewarded video ads in exchange for in-game hints or continues. Watching such ads is always optional.

We are not responsible for the content of third-party ads. If you encounter an ad you believe is inappropriate, please report it via the Google "Why this ad?" link or contact us.

8. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

The Site is not a medical or therapeutic service. The games are intended for entertainment and may not have any clinically proven effect on cognitive abilities or memory.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

These Terms are governed by the laws of Japan, without regard to conflict of law principles. To the extent permitted by law, any disputes shall be resolved in the courts of Japan.

For consumers, this clause does not deprive you of mandatory protections of your country of residence.
